A disabled Iraq veteran is suing McDonalds over claims he was harassed by employees for bringing his service dog into a Brooklyn restaurant.

Captain Luis Carlos Montalvan says he was berated by employees at the 5th Avenue McDonalds in Sunset Park on several occasions and told he wasn't allowed to have his pet in the fast food chain.

The decorated Iraq veteran then wrote a letter urging the company to comply with the Americans with Disabilities Act. When he returned to photograph a sign in the window welcoming service animals, Montalvan claims he was assaulted by men he believed to be McDonalds employees.

"He required medical assistance after the attack. He suffered neck injuries and was required to wear a collar around his neck and still sufferers to this day from those injuries, both physical and emotional," said Montalvan's lawyer, Robert Wolf.

A group of veterans is planning to protest outside the restaurant Tuesday on Montalvan's behalf.

McDonalds released a statement in response, saying, "We have a strict policy prohibiting any form of discrimination and continually strive to maintain an environment in which everyone feels valued and accepted."
