Lawsuit Filed Against City's Soda Ban

Beverage makers and restaurateurs are banding together in the hopes of fizzing out the Mayor's ban on large sodas and sugary drinks.

The American Beverage Association and other businesses filed suit Friday.

They want to block the measure that will keep drinks larger than 16 ounces from being sold in restaurants, theaters, concession stands or any other place that gets graded by the Health Department.

The suit claims an unelected health board shouldn't be telling people how much soda to drink.

A City Hall spokesman says the lawsuit is baseless and health officials had authority for the regulation.

The new rules are set to take effect in March.
